  1. HOUGHTON MIFFLIN INTERACTIVE LICENSE AGREEMENT
  2.  
  3. Before using this product, you should carefully read the following questions
  4. and answers. Using this product indicates your acceptance of the terms and
  5. conditions contained in the answers. If you do not agree with them, you should
  6. return the product and your money will be refunded.
  7.  
  8. Q:  WHAT DOES THIS PRODUCT INCLUDE?
  9. A:  This product includes compact disc(s); software recorded on the disc(s);
  10. contents delivered by the software; and printed documentation.
  11.  
  12. Q: HOW MAY I USE THE PRODUCT?
  13. A: You may use the product as follows:
  14.  
  15. You may print, transmit or modify the contents only for your individual use.
  16. The product identifies any contents owned by rights holders other than Houghton
  17. Mifflin Interactive and you may only use those contents in accordance with
  18. current copyright law. You may only copy the software onto a single computer
  19. for use on that computer and you may make one archival copy of the software for
  20. backup purposes only. You may not remove or obscure any copyright, trademark,
  21. proprietary rights, disclaimer, or warning notice included on or embedded in
  22. any part of the product. It is illegal to reverse compile, reverse assemble,
  23. reverse engineer, modify, or merge the software. You may not create derivative
  24. works based upon the software in whole or in part.

  26. Q:  MAY I USE THE PRODUCT ON MORE THAN ONE COMPUTER?
  27. A:  You may use the product on more than one computer as long as there is  no
  28. possibility that two different people will use the product on two different
  29. computers at the same time.  If you want to use the product on more than one
  30. computer at a time, you must obtain separate copies for each computer location
  31. from Houghton Mifflin Interactive.

  33. Q: MAY I USE THE PRODUCT ON A NETWORK?
  34. A: If you want to use the product on a network, you must obtain a network
  35. license from Houghton Mifflin Interactive.

  37. Q:  WHO OWNS THE PRODUCT?
  38. A:  You own the disc(s) on which the software and its contents are recorded.
  39. Houghton Mifflin Interactive grants you a license to use the software and its
  40. contents in accordance with the terms and conditions set forth in this License
  41. Agreement.  Houghton Mifflin Interactive and its licensors own and retain all
  42. title, copyright, trademark, and other proprietary rights in and to the
  43. software and its contents.

  45. Q:  MAY I GIVE THE PRODUCT TO ANOTHER PERSON?
  46. A:  You may transfer your license to use the product to another person as long
  47. as you permanently transfer the entire product (including all disks, all copies
  48. of the software program and all documentation provided in this package) without
  49. keeping a copy for yourself.  If you transfer your license, the recipient
  50. agrees to the terms and conditions of this License Agreement. You may not
  51. otherwise license, sublicense, rent, or lease the product without permission from 
  52. Houghton Mifflin Interactive.

  54. Q:  WHAT CAN I DO IF THE PRODUCT IS DEFECTIVE?
  55. A: You may return a defective disc within 30 days after you acquire it by
  56. sending it to Houghton Mifflin Interactive, Attn: Technical Support, 120 Beacon
  57. Street, Somerville, MA  02143.  Provided the disc has not been physically
  58. damaged, Houghton Mifflin Interactive will replace the defective disc.

  60. LIMITED WARRANTY.  EXCEPT AS STATED ABOVE, HOUGHTON MIFFLIN
  61. INTERACTIVE MAKES NO WARRANTIES, EITHER EXPRESS OR IMPLIED,
  62. INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY
  63. OR FITNESS FOR A PARTICULAR PURPOSE.

  65. REMEDY.  Your sole remedy is the replacement of a defective disc, as provided above.
  66.  
  67. NO LIABILITY FOR DAMAGES. IN NO EVENT SHALL HOUGHTON MIFFLIN
  68. INTERACTIVE OR ANYONE ELSE WHO HAS BEEN INVOLVED IN THE
  69. CREATION, PRODUCTION, OR DELIVERY OF THE PRODUCT BE LIABLE
  70. FOR ANY DIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, SUCH
  71. AS, BUT NOT LIMITED TO, LOSS OF ANTICIPATED PROFITS,
  72. BENEFITS, USE, OR DATA RESULTING FROM THE USE OF THE PRODUCT,
  73. OR ARISING OUT OF ANY BREACH OF ANY WARRANTY.

  75. OTHER RIGHTS.  Some states do not permit exclusion of implied warranties or
  76. exclusion of  incidental or consequential damages. The above exclusions may not
  77. apply to you. This warranty provides you with specific legal rights. There may
  78. be other rights that you may have which vary from state to state.

  80. Q:  ARE THERE ANY RESTRICTIONS ON GOVERNMENT USE OF THE PRODUCT?
  81. A:  Houghton Mifflin Interactive provides this product to government agencies
  82. with restricted rights.  Restrictions on government use, duplication and
  83. disclosure are set forth in subparagraph (c)(1)(ii) of the Rights in Technical
  84. Data and Computer Software clause at DFARS 252.227-7013 and subparagraph (c)(1)
  85. and (2) of the Commercial Computer Software - Restricted Rights clause at FAR
  86. 52.227-19.
